US Supreme Court votes to curb nationwide injunction on Trump citizenship order

The US Supreme Court has partially blocked rulings that froze US President Donald Trump’s executive order to end birthright citizenship nationwide, in a win for the administration’s agenda.

In a 6-3 decision, the top court on Friday granted the government’s request to limit injunctions handed down by lower courts, restricting their ability to block policies from taking effect nationwide.

The court did not rule on the merits of birthright citizenship itself. The opinion focused on nationwide injunctions rather than the merits of the executive order.

The administration had asked the court to consider whether judges in lower courts should have the authority to issue rulings that had an impact well beyond the parties in a case, rather than the constitutionality of the order itself. 

“When a court concludes that the Executive Branch has acted unlawfully, the answer is not for the court to exceed its power, too,” the majority opinion said.
